Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the pngr.dev website, web app, API, command-line tool, and MCP server (together, the “Service”), operated by Fine Ventures LLC(“pngr”, “we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

pngr.dev is a multi-tenant URL-monitoring platform. It lets teams monitor HTTP/HTTPS endpoints for availability, latency, and content correctness, manage incidents, and route notifications through channels such as Slack, Microsoft Teams, Telegram, email, SMS, and generic webhooks. The same functionality is available through our API, CLI, and MCP server.

2. Accounts and eligibility

  • You must be at least 16 years old and able to form a binding contract to use the Service.
  • You must provide accurate information and verify your email address. Passwords must be at least 12 characters.
  • You are responsible for all activity under your account and any API tokens issued to you, including actions taken by automated tools or AI agents you configure with your tokens. Keep your credentials secret and notify us promptly of any unauthorized use.

3. Organizations and roles

The Service is organized around organizations with role-based access: Owner, Admin, Member, and Viewer. An organization’s Owner is responsible for the members they invite, the roles they grant, and the data added to the organization. Inviting or granting access to others does not relieve you of responsibility under these Terms.

4. Acceptable use

You agree that you will not:

  • Configure monitors against endpoints you do not own or are not authorized to probe. You may only use the checker against systems you control or have explicit permission to test. Do not use the Service to scan, load-test, attack, or otherwise burden third-party systems.
  • Attempt to circumvent the minimum 60-second check interval, the per-user API rate limits, or any other technical limit of the Service.
  • Submit unlawful, infringing, or malicious content in monitor configuration, request bodies, or notification payloads.
  • Use notification channels — particularly email and SMS sent through our providers — to transmit spam or unsolicited messages, or in violation of anti-spam or telecommunications laws.
  • Reverse engineer, resell, or abuse the Service, the API, or the MCP server, or interfere with their operation or security.

5. Monitoring and alerts are best-effort

We work to detect outages and deliver your alerts reliably, but you acknowledge that monitoring is inherently best-effort. Checks currently run from a single region; detection depends on network conditions; and notification delivery depends on third parties (such as Slack, Twilio, and Resend) and on the channels and rules you configure. We do not guarantee that every outage will be detected or that every alert will be delivered. The Service must not be relied upon as the sole safeguard for life-safety, emergency, or other critical systems.

6. Plans, fees, and billing

The Service offers a free tier and paid plans (currently Pro and Team). The features and limits of each plan are described on our pricing page and shown in the app. Paid plans are billed as recurring monthly subscriptions through our payment provider, Paddle, which acts as the merchant of record and handles payment processing and any applicable sales tax or VAT.

Paid subscriptions renew automatically each billing period until cancelled. You can upgrade, downgrade, or cancel at any time from your billing settings: an upgrade takes effect immediately and the difference is prorated, while a cancellation takes effect at the end of the current paid period — you keep your paid features until then. Except where required by law, fees already paid are non-refundable. We may change pricing and plan limits on reasonable notice; changes do not apply retroactively to a billing period already paid.

7. Your content and data

You retain ownership of the configuration and data you submit to the Service. You grant us a worldwide, non-exclusive license to host, process, and transmit that content solely to operate and improve the Service. You represent that you have the rights necessary to submit it — including the right to monitor the endpoints and to message the recipients you configure. Our handling of personal data is described in our Privacy Policy.

8. Intellectual property

The Service, including its software, design, and brand, is owned by pngr and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. All rights not expressly granted are reserved.

9. API, CLI, and MCP access

Programmatic access via personal access tokens, the CLI, and the MCP server is subject to these Terms and to our rate limits. Tokens act with the permissions of the issuing user across their organizations; treat them like passwords. You are responsible for revoking tokens you no longer need.

10. Service availability and changes

We aim for high availability (99.9% is an operational target, not a contractual service-level commitment unless agreed separately in writing). We may perform maintenance, and we may modify, suspend, or discontinue features of the Service. We will use reasonable efforts to give notice of material changes.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that risks harm to others or to the Service. On termination, your data is handled as described in the Privacy Policy, including the 30-day recovery window before permanent deletion.

12. Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will detect every incident.

13. Limitation of liability

To the maximum extent permitted by law, pngr will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us in the 12 months before the claim, or USD 100.

14. Indemnification

You agree to indemnify and hold pngr harmless from any claims, damages, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms — including claims that you monitored endpoints or messaged recipients without authorization.

15. Governing law and disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Travis County, Texas, and you and we consent to the personal jurisdiction of those courts.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, for material changes, provide a more prominent notice. Your continued use of the Service after an update means you accept the revised Terms.
